The hearing was called to order at 8:06 p.m.

#1546              Friedman, Cathy and Mark                           8 Weyman Ln.

Applicants seeks a variance relative to an in-ground pool within the required property line setback.  Property is located at 8 Weyman Ln. and is situated in the Sharon Woods Subdivision.

 

The Board and Applicant reviewed the new plot plan showing 10.3 ft. setback from the deck, 8.2 ft. setback from the conservation property .  New plot plan dated 2/3/06.

 

The Board is reviewing the previous plans.

 

Hearing closed by the Applicant at 8:14 p.m.

Conditions:  Built as proposed in the plot plan dated 2/3/06.  The pool to be in the rear setback shall be no closer than 7.5 ft. from the rear property line.

Applicant seek two findings and a special permit relative to proposed replacement single family home on a nonconforming lot.  Property is located at 21 Beach Road and is situated in the Rural 2 Zone within the Surface Water Protection District.

Board of Health letter dated 2/6/06 read.  Stating the placement of the garage at 21 Beach Rd. will not effect the Board of Health decision or the functioning of the proposed septic system.

 

Conservation Commission letter dated 2/7/06 read.  Stating no particular problem with the inclusion of a garage within the footprint of the proposed residence as depicted on the January 6, 2006 Board of Health plan.

 

The Board and Applicant reviewed the new plot plan and documents.

 

The property shall be restricted to a 2 bedroom home.

 

On the second floor there are two bedroom with two full bathrooms.  The bathrooms have shower stalls and there is a Jacuzzi tub in between the 2 bathrooms that is share with there daughter.  There is a half bathroom on the first floor.

 

The existing living space is 900 sq. ft. and the proposed living space 1977 sq. ft and is a 46 % increase.

Vote in Favor with the plans dated 2/7/06 and the plot plan dated 1/30/06.

Conditions:  The proposed structure shall be restricted to a two bedroom dwelling in compliance with the variances granted by the Board of Health.

 

In Findings: There shall be a reduction of the nonconforming use of the setback.

New Case

#1549 Dixon, James                                                              192 Mansfield Street

Applicant seek two findings and two special permits relative to proposed expansion to nonconforming structure on a conforming lot.  Property is located at 192 Mansfield St. and is situated in the Rural 1 Zoning District

Board of Health letter dated 2/6/06 read.  Stating the proposed habitable space addition will not increase design flow.  The number of bedrooms will remain at 3.

 

Conservation Commission letter dated 2/7/06 read.  No objection.

 

Applicant described plans to add a first floor addition of a master bedroom with full bath and a new deck off the master bathroom.  On the second floor the proposed study that was once used as a very small bedroom with the entrance way to the attic.  That is why they are adding the first floor addition.  That daughter will move into there old bedroom. The closet door in the study shall be closed off and opened up the door in the hall way for a linen closet.  There shall be no door in the study area.

 

The existing living space is 1675 sq. ft. and the proposed living space is 424 sq. ft. an increase of 25%.

 

Vote in Favor with new plans depicting changes.

Condition: The closet door in the study shall be closed off and opened up the door in the hall way for a linen closet.  There shall be no door in the study area.
